Terms and Conditions
Effective date: September 17, 2026
1. About these terms
HighPaceGrowth (“we,” “us,” or “our”) provides email marketing services for residential home-service businesses. These Terms and Conditions apply to use of our public website at www.highpacegrowth.com (the “Website”).
Please read these Terms before using the Website. If you do not agree with these conditions, please do not use the Website.
Browsing the Website, viewing examples, or submitting an inquiry does not purchase services, commit you to a plan, or authorize a payment or recurring charge.
2. Client services and separate agreements
Our services are governed by a separately signed client agreement and any written work orders or amendments approved under that agreement. Those documents govern service scope, pricing, billing, cancellations, refunds, campaign approvals, deliverable ownership, and service-related responsibilities and liability.
If these Terms conflict with a signed client agreement concerning services, the signed client agreement controls. These Terms do not amend existing client agreements, change ownership of client materials or completed work, or replace separately required payment authorization.
3. Permitted use
You may browse the Website, evaluate our services, share links to our pages, and contact us for legitimate business purposes.
You must not:
- Use the Website for unlawful activity or to infringe another person’s rights.
- Impersonate someone else or submit information you know is false or misleading.
- Submit malware, malicious links, spam, or material you are not authorized to provide.
- Attempt unauthorized access to our systems, accounts, or information.
- Disrupt the Website or use automated requests in a way that interferes with its operation or other visitors’ access.
We may take reasonable steps to prevent misuse or restrict access involved in these activities. Restricting access to the public Website does not independently cancel a client agreement or remove obligations under it.
4. Website content and ownership
Website text, branding, designs, images, and sample emails are owned by HighPaceGrowth or used with permission, subject to applicable third-party rights and licenses.
You may view the content and retain reasonable copies for your own internal evaluation of our services, keeping any copyright or ownership notices intact. Other than uses permitted by applicable law or an applicable license, you may not sell, commercially reproduce, republish, or redistribute our content without written permission. Linking to a page does not grant permission to reproduce its contents or imply our endorsement.
Client materials and third-party names, logos, and content remain subject to their owners’ rights. These Terms do not transfer ownership of materials you submit or give us unrestricted permission to publish or use them in our marketing. Ownership and permitted use of client deliverables are governed by the applicable client agreement.
5. Website information, examples, and results
The Website provides general information about our services and approach. We aim to keep it accurate and current, but information may contain errors or become outdated. Contact us to confirm details relevant to a proposed engagement. Website updates do not change an existing client agreement.
The campaigns on our Email Examples page are fictional portfolio samples created to illustrate strategy, copy, and design. They are not evidence of work performed for the fictional businesses or of actual campaign results.
Examples, testimonials, past results, and descriptions of potential benefits do not guarantee particular revenue, leads, bookings, reviews, referrals, open rates, inbox placement, or other outcomes. Results depend on factors such as audience quality, offers, market conditions, and customer behavior.
These statements do not remove our responsibility for accurate advertising or limit express commitments in a signed client agreement or rights protected by applicable law.
6. Inquiries and privacy
When contacting us or submitting information, provide accurate details and only information and materials you are authorized to share. Please do not submit passwords, complete payment-card numbers, government identification numbers, or sensitive personal information through general inquiry forms.
Our Privacy Policy explains how we handle personal information, including website inquiries, onboarding information, and client customer information.
Submitting an inquiry allows us to respond to that inquiry; it does not automatically subscribe you to marketing emails. Visiting the Website or submitting a form does not provide blanket consent to marketing, personal-information processing, or recurring charges. Any consent or authorization required by applicable law must be obtained separately.
7. Third-party services and payments
Our Website and communications may link to or use services operated by other providers. These include Tally for client-intake forms, Brevo for inquiry-email delivery, and Stripe for payments and invoicing.
These providers have their own applicable terms and privacy notices. We do not control their independent operations, and their availability or features may change. This does not remove our responsibilities for our own conduct or our selection and use of providers under applicable law and our agreements.
Payment amounts, service periods, billing schedules, renewals, cancellations, and refunds are governed by the applicable client agreement and lawful, separately approved arrangements. Stripe processes payments through the payment process provided to the client. These Website Terms do not authorize charges or change an agreed refund or cancellation right.
8. Website availability, warranties, and liability
We may maintain, update, or temporarily suspend the Website. We do not promise uninterrupted or error-free availability.
To the extent permitted by applicable law, the public Website and its general informational content are provided “as is” and “as available,” without implied warranties of merchantability or fitness for a particular purpose. This provision applies to the public Website; it does not replace express commitments in a client agreement.
To the extent permitted by applicable law, HighPaceGrowth is not liable for indirect, incidental, special, or consequential losses arising solely from use of, or inability to use, the public Website. This includes lost profits only where they fall within those categories of loss.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. These provisions do not limit our obligations under a client agreement or our responsibilities for personal information under applicable law.
9. Governing law and changes
These Terms are governed by Florida law, subject to any mandatory laws that apply and cannot be displaced by agreement. These Terms do not require arbitration or designate an exclusive court location.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
We may update these Terms by posting a revised version and its effective date. Changes apply prospectively and do not alter accrued rights or amend existing client agreements. We will provide any additional notice or obtain any agreement required by applicable law.
